§ 9.8. Other provisions.

  • 9.8-1 Should a permittee die or move to a new location, the existing permit shall be automatically terminated, except that, in the case of death, should a surviving spouse or child residing at the same address desire to continue the home occupation, written notice to that effect shall be given to the zoning administrator, and the commissioner shall authorize continuation of that permit without further hearing.

    9.8-2 Persons with demonstrated physical handicaps may be permitted special consideration by the planning commission. The applicant may request waiver of a portion or all of one or more of the requirements as provided in section 9.3. This special request shall be considered by the zoning boards of appeals at a public hearing, after notice to property owners within 300 feet of the subject property. The zoning board of appeals may only grant waivers on the basis of applicant's physical inability to function within said requirements.
